On May 15, the Supreme Court heard arguments in the birthright citizenship case, a case related to the Trump regime trying to shred the constitutional right of citizenship to all people born in this country. If this attack goes forward, it will be a major leap in the consolidation of fascism. Very importantly, in front of the Supreme Court as this was happening, nearly 200 people protested to denounce this attack, and Refuse Fascism raised the demands Hands Off Birthright Citizenship and TRUMP MUST GO NOW! This message came through in pictures and interviews in international and national news outlets and articles about the case.

There were two rallies in front of the Supreme Court, one led by Refuse Fascism followed by one led by CASA, an immigrant rights service organization who is one of the litigants in the Supreme Court case. At the Refuse Fascism rally, Andy Zee gave people a deepened understanding of the stakes—of people being born into a new caste system of stateless people with no rights—and driving home that the demand “Trump Must Go Now!” isn’t “aspirational,” it’s a necessity. Others who spoke at the Refuse Fascism rally were a Maryland immigration lawyer who made a passionate argument for defending the rule of law and the courts, and a lawyer from the organization BAMN who had filed an amicus (support brief) in the birthright citizenship case. The rally also included the reading of a powerful statement from a university student calling students to act now to stop a fascist America, plus speakers from the local chapter.
CASA raised the slogan “Birthright Citizenship is a Constitutional Right” with a banner and signs, drawing out many people in their network including a number of Spanish-speaking migrants, and held a rally that included several politicians and focused on the effect of this attack on migrants and their children. When the hearing was over, the state attorneys general who had been in court came out, and one Black attorney general spoke very powerfully to the fact that she wouldn’t even be in her position had it not been for the 14th Amendment giving citizenship to Black people after the Civil War.
The Los Angeles chapter of Refuse Fascism held a press conference at the Federal Building that included Sunsara Taylor from Refuse Fascism; Reverend Oliver Buie; Alfonso Morales, an immigration attorney and school board member from Linwood, CA. Dolores Y. Leal, an attorney and ACLU Foundation Board member, and Stephen Rohde, a well-known civil rights attorney, sent statements to be read. Attorneys Robert Ring and Mia Yamamoto also spoke.
